13-1038. Street improvements; resolution; bonds.Whenever, in the judgment of the governing body of any city of the firstclass in the state of Kansas, it becomes expedient and a public necessityto recurb, regutter, resurface or repave or repair any street or alley orany portion thereof in said city, the governing body of said city may, byresolution, so declare the necessity for and cause said improvement to bemade regardless of protest or remonstrance, as herein provided.
All proceedings relating to such improvements and to the assessment ofbenefits for the payment of the costs thereof and for the issuance of bondsshall be the same as provided by law in case of pavement regardless ofprotest in the first instance, except as otherwise herein provided: Andprovided further, That no street or alley or any portion thereof shallbe recurbed, reguttered, resurfaced or repaved, under the provisions ofthis act until at least ten (10) years have elapsed subsequent to the dateof the completion of such original improvement.
