Article 10.--PUBLIC IMPROVEMENTS

     
13-10,133.   Same; bonds; protest petition; election
provisions.

The governing body of any city which has created a storm drainage
district under the provisions of this act may issue
general obligation bonds of the city or bonds payable by a tax levy
against property located within such district to pay the cost of
constructing storm sewers and drains within such districts. Such bonds
may either be paid by the watershed district or by the city at large or
by a combination thereof. Before any bonds are
issued, the governing body of the city shall cause to
be published once each week for two consecutive weeks in the
official city newspaper a notice of its intention to cause the
improvement to be made and to issue bonds of the city to pay the costs
thereof. The notice shall describe the improvement proposed to be made and the
amount of
bonds proposed to be issued. Such bonds may be issued and the
improvement made unless a petition requesting an election upon the
issuance of such bonds is filed in accordance with this section. Such petition
shall be signed by electors equal in number to not less
than 10% of the electors who voted at the last preceding
regular city election as shown by the poll books and shall be
filed in the office
of the city clerk within 20 days following the last publication
of such resolution. If a sufficient petition is filed within
the time provided, no such bonds shall be issued until the governing
body of the city shall have submitted the question to and received the
approval of a majority of the electors voting on the proposition at an
election called and held for such purpose.

     
Any election called and held and any bonds issued under the
provisions of this section shall be in the manner provided by the
general bond law.
