13-1235. Power to grant right to furnish electric energy to certaincustomers in cities over 110,000; application.In each city of the first class having a population of more than onehundred and ten thousand inhabitants which owns and operates a municipalelectric-light plant for the purpose of furnishing such city and itsinhabitants with electric energy, the governing body of such city is herebyauthorized to grant, to an individual, firm or corporation engaged in thebusiness of manufacturing and distributing electric energy, the right tofurnish, distribute and sell electric energy to customers within the city,when and only when such customers have first made application to themunicipal electric-light plant for a supply of electric energy and themunicipal electric-light plant has refused to furnish said electric energy.
