Article 12.--PUBLIC UTILITIES

      13-1246.   Retirement pension plan for employees and dependents incities over 120,000; agreement.The governing body of any municipality of the state of Kansas having apopulation of more than one hundred twenty thousand (120,000) and owningand operating a public utility or utilities is hereby empowered and may atits option enter into an agreement with its employees in said municipallyowned public utility or utilities providing for the establishment of aretirement pension plan for the benefit of said employees, their wives anddependents: Provided, That in any municipality of over one hundredtwenty thousand (120,000) population where the public utility or utilitiesare operated, managed, and controlled by a board of public utilities or anyother managing board, however designated, such managing board instead ofthe governing body of the municipality shall be empowered to enter into theagreement and establish the retirement pension plan provided for herein.
