13-1272.   Same; transfer of funds; determination of amount.The determination of the percentage to be transferredto funds to be used for governmentalfunctions as provided in K.S.A. 13-1271, and amendments thereto, shall bedetermined by the governing bodiesor operating or managing boards, as the case may be, of the utilities ofsuch cities, within the range of percentages shown in K.S.A. 13-1271, andamendments thereto. The determination of the percentage to be transferredshall be made by the board of public utilities on or before the first dayof May of the preceding year and the board shall notify the governing bodyof the city of such determination by such date. If the board fails to determine the percentage or fails to notify the governingbody of the city before the first day of May of any year, the board shalltransfer over a percentage which shall be no less than the percentage transferredin the preceding year.
