13-1326.   Change of grade; eminent domain proceedings.Before the grade of any road, parkway, boulevard, or street, or partthereof, under the control and management of the board of parkcommissioners, which has been established, shall be changed, if theproperty owners affected thereby shall not have waived all claim to damagestherefor, the board shall proceed to exercise the power of eminent domainin accordance with K.S.A. 26-501 to 26-516, inclusive.
