Article 10.--MISCELLANEOUS PROVISIONS

      14-1053.   Bonds for cemetery improvement in certain cities over 10,000; election.Whenever it is necessary or desirable in the opinion of thegoverning body of a city of the second class having a population of morethan 10,000 and located in a county having a populationof more than 40,000 to make any permanent improvementin a public cemetery owned by such city, including the paving orrepaving, macadamizing or remacadamizing, grading or regrading, orotherwise improving any road or roadway in such cemetery, such governingbody may by resolution declare the necessity and desirability of makingsuch improvement and such city is hereby authorized to issue and sellbonds of the city in an amount not exceeding $35,000, and to use the proceeds fromthe bonds for the making ofsuch improvements.

      No bonds shall be issued by any city under the authority conferred bythis section until the question of the issuance of the bonds hasbeen submitted to a vote of the qualified electors of such city at aregular city election, or at a special election called for that purpose,at which a majority of those voting on the question vote in favor of theissuance of the bonds.

      Such bond election shall be called and held and the bonds shall beissued, registered, sold, delivered and retired in accordance with theprovisions of the general bond law. All bonds issued under theauthority conferred by this act shall be subject to and within thebonded debt limitation provided by the laws of this state.
