Article 13.--BOARD OF COMMISSIONERS

      14-1305.   Vacancy in office of mayor or commissioner, how filled.In case of any vacancy from any cause in the office of mayor or anycommissioner, the remaining members of the board of commissioners within10 days after the occurrence ofthe vacancy shall elect somesuitable person to fill the vacancy for thebalance of the unexpired term of such office. If the remainingmembers cannot agree upon some such suitable person, then they shall callin the then city attorney who shall cast the decisive vote for suchappointment. The resignation of the mayor or any commissioner elected underthis act shall be made in writing for their action thereon. If the mayor orany commissioner shall remove from the territorial limits of the city,such removal shall ipso facto be deemed to create a vacancy in suchperson's office.
