Article 5.--PUBLIC IMPROVEMENTS

      14-533.   Same; hearing; installation.At the time and place set for the hearing of the petition, as providedin the next preceding section, it shall be the duty of the governing bodyto first ascertain and determine whether notice has been given of the timeand place fixed for the hearing, as required by this act; and if it shallbe determined that such notice has been given, to make a declaration andfinding of that fact, and cause the same to be entered upon the records bythe city clerk; and thereupon to hear all persons in favor of or opposed togranting the prayer of said petition, and all other evidence that it maydesire to hear for the purpose of ascertaining whether such petition issigned by the proper number of persons, possessing the qualificationprescribed in this act, and whether the statements of such petition aretrue; and if, upon such hearing, it shall be found that such petition is inconformity to the requirement of this act, and that the allegations thereofare true, and that it is advisable to so illuminate said street or portionof a street, and that the cost thereof will not be too burdensome upon thepersons to be directly benefited, then such governing body shall make afinding and decision to that effect, and shall, by resolution, declare theconstruction, installation, equipment and maintenance of such additionalsystem of lights as may be required for that purpose necessary to be done;and such governing body shall then have power to cause such additionalsystem of lighting to be constructed, installed, equipped, and maintained,and to contract therefor.

      The lights shall be of such kind and at such intervals as shall be fixedby the governing body: Provided, That the petitioners may specify thekind and number of lights to be installed and operated, subject to theapproval of the governing body.
