Chapter 15.--CITIES OF THE THIRD CLASS
PART I.--GOVERNMENT BY MAYOR AND COUNCIL AND GENERAL LAWS APPLICABLE TO CITIES OF THE THIRD CLASS
Article 2.--ELECTION, APPOINTMENT AND REMOVAL OF OFFICERS

      15-201.   Election of officers; terms;vacancies.Every two years an election shall be held for a mayor, and five councilmembers. The mayor and council membersshall hold their offices for twoyears and until their successors are elected and qualified.

      Subject to the provisions ofK.S.A. 2009 Supp.12-16,128, and amendmentsthereto, in case of avacancy in the council occurring by reason of resignation,death, or removal from office or from the city, the mayor, by and with theadvice and consent of the remaining council members, shall appoint anelector to fill the vacancy until the next election for that office. Incase any person elected as a council member neglects or refuses to qualifywithin 30 days after election, the council member shall bedeemed to have refused to accept the office and a vacancy shallexist. Subject to the provisions ofK.S.A. 2009 Supp.12-16,128, and amendmentsthereto, the mayor may, with the consent of the remaining council members,appoint a suitable elector to fill the vacancy.

      In case of a vacancy in the office of mayor, the president of thecouncil shall become mayor until the next regular election for that officeand a vacancy shall occur in the office of the council memberbecoming mayor.
