17-1322. Sale by one association of all unsold real property toanother owning land adjoining or in close proximity; purchase of assets. Where two cemetery associations have been organized, and the lands ownedand platted and dedicated by each of said associations adjoin or are insuch close proximity that the whole can be efficiently managed by one ofthe organizations and under one uniform platting and scheme, either one ofsaid associations, by its president and secretary, and by the consent anddirection of a majority of all the individual lot owners in saidassociation secured by vote to be taken at a meeting to be called by thesaid president thereof for that purpose, may sell and convey to such otherassociation, for general burial purposes, and in bulk, all the land andproperty of said association not already sold and conveyed to individuallot owners, and said property shall thereafter be held, managed anddisposed of by the purchasing association as is now by law provided:Provided, however, That notwithstanding any other statutes to thecontrary, any cemetery corporation, either private or public, or cemeteryassociation, whether for profit or nonprofit, may purchase the assets, realor personal of any other such cemetery organization, except for thoseburial lots already sold for burial purposes.
