17-1370. Cemetery districts in Sedgwick and Sumner counties;attachment of land in another county; petition; tax levy; transfer of moneys.In Sedgwick and Sumner counties, land adjacent to anestablished cemetery district which isa part of another organized cemetery district which lies in a county other thanwhere the greater portion of the cemetery district to which it is proposedto be attached lies may be detached from one district and attached to theother cemetery district in the following manner. Upon presentation to theboard of county commissioners of the county in which the greater part ofthe cemetery district lies, of a petition setting forth the boundaries ofthe area proposed to be attached to the cemetery district and signed by notless than 51% of the qualified electors of the area it shall be the duty ofthe board of county commissioners, at its next regular meeting, to examinethe petition. If the board finds that the petition is sufficient, theboard shall notify the board of each cemetery district and forward a copyof the petition filed. The board of the cemetery district to which theland would be attached shall return the petition accompanied by a copy of aresolution adopted by such board stating that the board desires such areato be attached to the cemetery district. The board of the cemeterydistrict from which the land would be detached shall return the petitionaccompanied by a copy of a resolution adopted by such board stating thatthe board desires such area to be detached from the cemetery district.
Upon receipt of the petition and the resolutions the county commissionersshall issue an order attaching such territory to the cemetery district andnotice of such attachment shall be given to the county clerk of the countywhere the territory seeking to be attached is located. The attachmentshall take effect on the first day of March next following the entry of theorder. Such attached territory shall be subject thereafter to the taxlevied by the cemetery district which district shall certify such levy tothe county clerk of the county of the territory attached, together with itsbudget, and such county clerk shall levy such tax on all the taxabletangible property of the county in the cemetery district. The treasurer ofthe county shall transfer before the fifteenth day of January and July ofeach year, all moneys belonging to the cemetery district, including allmoneys for the payment of bonds or interest of the district to thetreasurer of the district and thetreasurer receiving the moneys shall issue a receipt therefor and forwardit to the treasurer of the county from which the money was sent.
