Article 17.--RELIGIOUS, CHARITABLE AND OTHER ORGANIZATIONS

      17-1713.   Same; procedure for transfer of property.That an application for such an order and disposition of property may bemade by any member or officer of the said Kansas Baptist Convention, orby any member of such church or society, when duly authorized thereto bythe board of managers of said Kansas Baptist Convention, upon a verifiedpetition setting forth the facts authorizing such order and dispositionof property.

      Upon the presentation of such petition to the district court suchcourt may proceed in a summary manner, after such notice as the courtmay prescribe, to inquire into the merits of such application; and ifupon examination by the court it shall satisfactorily appear that themaking of the order and disposition of the property applied for isnecessary or proper, for any of the causes mentioned in K.S.A.17-1712, such court shall make a final order, declaringsuch church or society extinct and dissolving the same, and transferringany property and the title and possession thereof which may belong tosuch church or society, or held in trust for such church or society, andvesting the same in the said Kansas Baptist Convention; it being theintent and purpose of this act to preserve to the Baptist denominationof this state all property owned by or held in trust for any such churchor society for religious uses.
