17-1716. Same; procedure for transfer of property.That an application for such order and disposition of property may bemade by any member or officer of the said Kansas Christian MissionarySociety or by any member of such church or society when duly authorizedthereto by the board of directors of the Kansas Christian MissionarySociety upon a verified petition setting forth the facts authorizingsuch order and disposition of property.
Upon the presentation of such petition the court shall proceed in asummary manner, after such notice as the court may prescribe, to inquireinto the merits of such application; and if upon examination by thecourt it shall satisfactorily appear that the making of the order anddisposition of the property applied for are necessary and proper for anyof the causes mentioned in K.S.A. 17-1715, such courtshall make a final order, declaring such church or society extinct anddissolving the same; transferring the title and possession of anyproperty which may belong to such church or society, or which may beheld in trust for such church or society; and vesting the same in thesaid Kansas Christian Missionary Society. It being the intent andpurpose of this act to preserve to the denomination of the ChristianChurch, Church of Christ (using instrumental music), or Disciples ofChrist in this state all property owned by or held in trust for any suchextinct church or society of such denomination.
