17-2361.   Acquisition of property; eminent domain.A municipality shall have right to acquire by the exercise of the powerof eminent domain any real property which it may deem necessary for itspurposes under this act after the adoption by it of a resolution declaringthat the acquisition of the real property described therein is necessaryfor such purposes. A municipality may exercise the power of eminent domainin the manner provided in article 5 of chapter 26 of Kansas StatutesAnnotated and any acts amendatory thereof or supplemental thereto. Propertyalready devoted to a public use may be acquired in like manner, providedthat no real property belonging to the state or a state public body beacquired without its consent.
