Article 49a.--UNIFORM TRANSFER ON DEATH SECURITY REGISTRATION ACT

      17-49a01.   Definitions.As used in the uniform TOD security registration act:

      (a)   "Beneficiary form" means a registration of a security which identifiesthe present owner of the security and the intention of the owner regarding theperson or persons who will become the owner or owners of the securityupon the death of the owner.

      (b)   "Person" means an individual, a corporation, a partnership, anassociation, trust or an organization.

      (c)   "Register" including its derivatives, means to issue acertificateshowing the ownership of a certificated security or, in the case of anuncertificated security, to initiate or transfer an account showing ownershipof securities.

      (d)   "Registering entity" means a person who originates ortransfers asecurity title by registration, and includes a broker maintaining securityaccounts for customers and a transfer agent or other person acting for or as anissuer of securities.

      (e)   "Security" means a certificated or uncertificatedsecurity as defined in K.S.A. 84-8-102, and amendments thereto,or as defined in K.S.A.17-12a102, and amendments thereto, or a security account.

      (f)   "Security account" means (1) a reinvestment accountassociated with asecurity, a securities account with a broker, an agency account with a bank ortrust company, a cash balance in a brokerageaccount, cash, interest, earnings or dividends earned or declared on a securityin an account, a reinvestment account or a brokerage account, whether or notcredited to the account before the owner's death, or (2) a cash balance orother property held for or due to the owner of a security as a replacement foror product of an account security, whether or not credited to the accountbefore the owner's death.

      (g)   "State" includes any state of the United States, theDistrict ofColumbia, the Commonwealth of Puerto Rico and any territory or possessionsubject to the legislative authority of the United States.
