Petition for certificate of incorporation; notification andhearing.At any time hereafter any five or more individuals (hereinafter referred toas the "incorporators"), citizens of this state, may form an association topromote thrift and home financing, subject to approval as hereinafterprovided in this act, by signing and acknowledging before anofficer competent to take acknowledgments of deeds, two copies of apetition for a certificate of incorporation in substantially thefollowing form, which shall be filed with the commissioner, accompaniedby the incorporation fee:

The undersigned respectfully apply for permission to organize asavings and loan association under the name and style of __________Savings and Loan Association __________, with home office to be locatedat __________, in the county of __________. In support of our petition,we submit the following:
1. All petitioners are citizens of the state of __________ and aredesirous of forming a local mutual thrift and home-financing associationin which people may invest their funds and which will provide primarilyfor the financing of homes.
2. All petitioners are responsible persons of good character. Thereis a need for such an institution in the community in which the homeoffice of the association is to be located; there is a reasonableprobability for its success and usefulness; and it can be establishedwithout undue injury to existing properly conducted local thrift andhome-financing institutions.
3. Applicants are ready to submit to the savings and loancommissioner and to the savings and loan board such evidence of thefacts herein stated as required by the commissioner or the board.
4. Petitioners agree not to represent themselves as authorized to dobusiness until this application is approved and further agree that uponissuance of a certificate of incorporation to such petitioners, theywill proceed only in accordance with provisions of the savings and loanact and rules and regulations made thereunder.
5. Upon the receipt of this petition, the commissioner shall notify eachassociation having its home office in the applicant's county of suchpetition for certificate of incorporation, by registered mail. Suchnotification shall contain the information required under subsection (e) ofK.S.A. 77-518 and amendments thereto. The savings and loan boardshall conduct a hearing on the petition in accordance with the provisionsof the Kansas administrative procedure act. The board shall inquire intothe advisability of the issuance of a certificate of incorporation andshall approve or disapprove the incorporation.
