17-5607.   Approval of petition for certificate of incorporation; hearing.Upon the receipt by the commissioner of a petition for a certificate ofincorporation signed and acknowledged as provided in this act accompaniedby the incorporation fee, the commissioner shall immediately inquire intothe advisability of issuing a certificate of approval of the incorporationof such association and shall thereupon recommend to the board the approvalor disapproval of the incorporation. The commissioner shall immediatelyforward such commissioner's recommendations regarding the incorporation,with the reasons therefor, to the board and such commissioner's recordsshall be available to the board at all times. The board shall conduct ahearing on the petition in accordance with the provisions of the Kansasadministrative procedure act and shall approve or disapprove theincorporation. If the board approves the incorporation the commissionershall issue a certificate of approval substantially in the form provided in this act.
