17-5812. Fraudulent acts; civil liability; felony.Any officer, director, trustee, attorney, agent or servant of anyassociation heretofore or hereafter to be incorporated who shall use ordispose of any part of the moneys, property, assets or funds of suchassociation, or assign, transfer, cancel, deliver up or acknowledgesatisfaction of any bond, mortgage or other written instrument belonging tosuch association, unless duly authorized or otherwise than in the regularand legitimate business of the association, or who shall be guilty of anyfraud in the performance of duties, shall be liable civilly to theassociation, and also to any other party injured, to the extent of thedamage thereby caused, and shall also be guilty of a felony, and uponconviction thereof shall be imprisoned in thecustody of the secretary of corrections for not lessthan one nor more than five years.
