17-631. Same; certificate required as condition for filing.
The secretary of state shall not receive for record or for filing any
mortgage or deed of trust described in K.S.A. 17-630,
unless and until the same has thereon the certificate of a register of
deeds that the same has been presented to him pursuant to the provisions
of K.S.A. 79-3101 to 79-3107, inclusive, and that any real estate mortgage
tax, if any is due, has been paid or that none is due thereon, as the
case may be.
