Chapter 19.--COUNTIES AND COUNTY OFFICERS
Article 1.--GENERAL PROVISIONS

      19-119.   County equipment reserve fund; purpose; investment andtransfer of moneys in fund.(a) The board of county commissioners of any county may provide, byadoption of a resolution, for a county equipment reserve fund to financethe acquisition of equipment. Moneys may be budgeted and transferred tosuch fund from any source which may be lawfully utilized for such purposes,including equipment use charges on the various departments and agencies ofthe county to finance new and replacement equipment. For the purposes ofthis act, equipment shall include machinery, vehicles and any otherequipment or personal property including, but not limited to, computerhardware and software, which the county is authorized to purchase for municipal purposes.

      (b)   Moneys credited to such fund from annually budgeted transfers shallnot thereafter be subject to the provisions of K.S.A. 79-2925 to 79-2937,inclusive, and amendments thereto. In making the budgets of such county,the amounts credited to, and the amount on hand in, such equipment reservefund and the amount expended therefrom shall be shown thereon for theinformation of the taxpayers of such county. Moneys in such fund may beinvested in accordance with the provisions of K.S.A. 10-131, andamendments thereto, with interest thereon credited to such fund.

      (c)   If the board of county commissioners determines that money which hasbeen credited to such fund or any part thereof is not needed for thepurposes for which so budgeted or transferred, the board may transfer, byadoption of a resolution, such amount not needed to the fund from which itcame and such retransfer and expenditure thereof shall be subject to thebudget requirement provisions of K.S.A. 79-2925 to 79-2937, inclusive, andamendments thereto.
