19-1585. Certain counties over 50,000; additional bonds for siteand the building and equipping of courthouse or jail; resolution.That any county having a population of more than fifty thousand (50,000)and in which there is no city of the first class, which prior to theeffective date of this act, has levied taxes and created a special fundunder the provisions of section 19-1569 of the General StatutesSupplement of 1947, for the purpose of acquiring a site for andbuilding, equipping and furnishing a courthouse and jail, or for any oneor more of such purposes the board of county commissioners may adopt aresolution stating (a) the total amount necessary to pay for saidproject, and (b) the total amount necessary for such special fund asstated in the original resolution adopted pursuant to the provisions ofsection 19-1569 of the General Statutes Supplement of 1947, and (c) thetotal amount of bonds, if any, which have been issued under theprovisions of section 19-1570 of the General Statutes Supplement of1945, and section 19-1570 of the General Statutes Supplement of 1947,and (d) the total amount, to the date of adoption of said resolution,collected by said county pursuant to the levy authorized by section19-1569 of the General Statutes Supplement of 1947, and (e) that thetotal amount so collected by tax levy is insufficient to pay for saidproject and that it is necessary to issue and sell bonds, stating theamount thereof.
Such resolution shall be published for three successive weeks in theofficial county paper; whereupon, such bonds, in an amount not exceedingthat stated in the resolution, herein provided, as the amount necessaryto be issued, which amount of bonds together with (1) the amountcollected by the levy authorized by said section 19-1569 of the GeneralStatutes Supplement of 1947, and (2) the total amount of bonds thereforeissued under the provisions of section 19-1570 of the General StatutesSupplement of 1945, and section 19-1570 of the General StatutesSupplement of 1947, shall not exceed by more than one hundredtwenty-five (125) percent the total amount stated in the originalresolution of the board adopted and published in accordance with theprovisions of section 19-1569 of the General Statutes Supplement of1947, may be issued and sold under the term of this act: Provided,That no bonds shall be issued under this act until the question ofissuing the same shall have been submitted to the qualified electors ofthe county at an election as provided for in K.S.A. 19-1587.
