19-15,122. Same; general obligation bonds; resolution;publication; petition; election.The board of county commissioners shall first determine the total amountnecessary to be expended for the purposes enumerated in K.S.A. 19-15,120and 19-15,121 and the amount sodetermined shall be included in the resolution and publicationhereinafter provided for.
Subject to the provisions hereinafter contained, the board of countycommissioners may issue and sell in the manner provided by the generalbond law, bonds of the county in an amount which will not exceed thetotal amount stated in said resolution and publication and authorized bythis act: Provided, That no contract shall be let or bonds issuedunder this act until a resolution is adopted by the board of countycommissioners stating (a) that they deem it advisable to acquire a siteor build district court facilities, (b) the total amount determinednecessary to pay for such items or both, (c) that it is necessary toissue and sell bonds, stating the amount thereof, in payment therefor.Such resolution shall be published for three (3) successive issues inthe official county paper. Whereupon, the board of county commissionersmay advertise for proposals for the doing of such work, award contractstherefor in the manner now provided by law, contract for sites orinstitute eminent domain proceedings therefor, and issue bonds of suchcounty in payment thereof, unless a petition protesting the adoption ofsuch plan signed by at least five percent (5%) of the qualified electorsof such county as certified to the county commissioners by the countyelection commissioner, is filed with the county clerk of such countywithin thirty (30) days following the date of the last publication ofsuch resolution. In such event, the board of county commissioners shallsubmit the question of issuance of the bonds to the voters of suchcounty at an election called and held, in the manner provided for thecalling and holding of elections upon the question of issuing bonds,under the general bond law, for such purpose or at the next generalelection.
