19-1933. Chase county jail; transfer of property from public buildingcommission; duties of county commissioners.(a) Within 10 days after the effective date of this act, the Chase countypublic building commission shall initiate action to transfer, and within 60days shall transfer to the board of county commissioners of Chase countythe title and all interest in property acquired by such commission for thepurpose of constructing the Chase county jail located in Cottonwood Falls,and more particularly described as follows:
A tract of land in the northwest quarter of the southwest quarter ofsection 28, township 19 south, range 8 east of the sixth principalmeridian, Chase county, Kansas, described as follows:
Beginning at a point on the west line of section 28, such point being S00°00'00" W 773.30 feet from the northwest corner of thesouthwest quarter; thence S 00°00'00" W 316.70 feetalong the west line of the southwest quarter; thence N89°59'13" E 339.00 feet; thence N00°00'00" E 316.70 feet parallel to the west line of thesouthwest quarter; thence S 89°59'13" W339.00 feetto the point of beginning. EXCEPT the following described tract of land,to-wit: Beginning at a point on the west line, 773.3 feet south of thenorthwest corner of the quarter section; thence N 88°56' E 17.5feet; thence S 01°15' E 244.7 feet; thence N88°45' E 25.0feet; thence S 01°15' E 722.2 feet; thence S89°10' W to apoint on the west line, 316.7 feet south of the place of beginning; thenceN 01°17' W 316.7 feet along the west line to the place ofbeginning.
(b) At the time of the transfer of the record title, the board of countycommissioners of Chase county shall agree to perform the obligations andresponsibilities of the Chase county public building commission withrespect to the outstanding Chase county public building commission revenuebonds series 1991 (Chase county, Kansas, county jail and sheriff'sdepartment project) dated September 1, 1991, in the aggregate principalamount of $1,225,000 issued by the commission to pay the cost of thefacility as if the bonds were issued by Chase county. The board of countycommissioners shall notify the bond holders and bond underwriters and holdharmless the Chase county public building commission from any and allobligations or liabilities arising out of such bond issue.
(c) Language incorporating the provisions of subsection (b) shall beincluded in the deed or other instrument making the transfer of title.
