Chapter 19.--COUNTIES AND COUNTY OFFICERS
Article 2.--COUNTY COMMISSIONERS

      19-216a.   Contracts for bridges damaged or destroyed by disaster.The provisions of K.S.A. 19-214, 19-215 and 19-216, andamendments thereto, shall not apply to contracts for the expenditure of countymoneys for the reconstruction or repair of a bridge if:

      (a)   The bridge has been damaged or destroyed as a result of a disaster;

      (b)   the governor has declared the county, or that part of the county inwhich the bridge is located, a disaster area;

      (c)   the board of county commissioners finds that a hardship would result ifthe bridge is not immediately reconstructed or repaired;

      (d)   the board of county commissioners has obtained an estimate of the costof the reconstruction or repair of the bridge from the county engineer. Ifthere is no county engineer, the board shall obtain such estimate from theKansas department of transportation; and

      (e)   the contract for the reconstruction or repair of the bridge is awardedwithin 60 days of the governor's declaration required by paragraph (b).
