19-2106c.   Use of proceeds of certain bonds issued for homes foraged in certain counties in conjunction with bonds hereafter issued orwith sinking funds established to provide home for aged.Whenever any county has prior to the effective date of this act issuedits general obligation bonds in the sum of sixty thousand dollars($60,000) for the purpose of acquiring a site for and building andequipping of a county home for the aged in accordance with theprovisions of K.S.A. 19-2106b; and the ballot on which the question of issuingsuch bonds of thecounty contained the proposition that funds derived from the sixtythousand dollar ($60,000) bond issue were to be used with some thirtythousand dollars ($30,000) then held in escrow for the purpose ofbuilding a ninety thousand dollar ($90,000) home for the aged in thecounty, said sum of thirty thousand dollars ($30,000) to be delivered tothe county when and if the bond election was approved by the voters ofsuch county; and the bond issue was approved at a special election bythe voters and was legal in all respects and thereafter bonds wereissued and bond and interest levies made, but the moneys held in escrowwere returned to the donor when construction of the home was not begunin accordance with the grant; and where said sixty thousand dollars($60,000) together with any interest is insufficient to build anadequate home in such county, the board of county commissioners of suchcounty is hereby authorized to use the said sum of sixty thousanddollars ($60,000) for the purposes for which the bonds were issued,together with any interest or income therefrom, together with proceedsfrom any bonds which may be subsequently issued by such county inaccordance with law; or may use such bond proceeds and income therefromin conjunction with any sinking funds which may be hereafter establishedby the county for a home for the aged as provided by law, but such fundsshall be used, in any case, only for the purpose of acquiring a site forand building and equipping a home for the aged in the county which hasheretofore issued the bonds.
