Article 21.--HOMES FOR THE AGED

      19-2106e.   Homes for the aged in certain counties; operation; taxlevy, use of proceeds; protest petition and election.The board of county commissioners of any county having a population ofnot more than three thousand five hundred (3,500) and a taxable tangiblevaluation of not more than twenty-five million dollars ($25,000,000) andthe board of county commissioners in any county having a population ofmore than five thousand seven hundred (5,700) and not more than tenthousand (10,000) and a taxable tangible property valuation of more thantwenty-nine million dollars ($29,000,000), and which county hasestablished a home for the aged as provided for in K.S.A.19-2106 is hereby authorized to make an annual tax levy for theoperation of said home and to pay a portion of the principal andinterest on bonds issued under the authority of K.S.A. 12-1774, and amendmentsthereto, by cities located in the county.

      Any tax levy provided for or authorized by this section may not bemade if prior to the levy of such tax a petition in opposition to thelevy, signed by not less than five percent (5%) of the qualifiedelectors in such county, is filed with the board of countycommissioners. If such petition is filed within the prescribed time, nosuch tax may be levied, unless a majority of the qualified electorsvoting upon such proposition approve such levy at the next generalelection.
