19-2659. Same; costs; bonds; election, when; exemption from countybonded debt limitations.For the purposes of paying the cost of acquiring any lands or making anyimprovements thereon or the acquisition of any equipment for the purposeshereinbefore authorized, the board of county commissioners may use moneysfrom the general fund, from any refuse disposal fund created under theprovisions of this act, from the sale of property as hereinafter provided,or may issue general obligation bonds or bonds payable from revenue derivedfrom service charges made for the use of the facility of the county ashereinafter provided. Before any bonds shall be issued by any county underthe provisions of this act, the board of county commissioners shall publisha notice once each week for two (2) consecutive weeks in the officialcounty newspaper. Such notice shall state the purpose, whether foracquisition or improvement of a site, or both, describing any suchimprovement, or the acquisition of equipment, for which such bonds are tobe issued and the amount of the bonds to be issued therefor and whetherthey are to be general obligation bonds or revenue or part generalobligation bonds and part revenue bonds. If within thirty (30) days afterthe last publication of said notice there shall be filed in the office ofthe county clerk, not later than five (5) o'clock p.m. on the last day, aprotest signed by electors of the county equal in number to not less thanten percent (10%) of the electors who voted in such county for thesecretary of state at the last preceding general election, an electionshall be called and held within ninety (90) days after the last publicationof the notice or at the next general election if held within that time. Thesignatures to such protest need not all be appended to one (1) paper butone (1) of the signers of each such paper shall make oath before an officercompetent to administer oaths that each signature to the paper is thegenuine signature of the person whose name it purports to be. Such electionshall be called and held in the manner provided by the general bond law forbond elections. If no protest or no sufficient protest is filed or if anelection is held and the proposition carries by a majority of those votingthereon at the election, the board of county commissioners may provide forthe issuance of such bonds for the purposes and in the amount or amounts(if part are general obligation and part revenue bonds) provided in thepublished notice in the manner provided by law. Such bonds are herebyexempt from and shall not be included in computing the total bondedindebtedness of any county as prescribed by article 3 of chapter 10 of theKansas Statutes Annotated.
