19-2659. Same; costs; bonds; election, when; exemption from county
bonded debt limitations.
For the purposes of paying the cost of acquiring any lands or making any
improvements thereon or the acquisition of any equipment for the purposes
hereinbefore authorized, the board of county commissioners may use moneys
from the general fund, from any refuse disposal fund created under the
provisions of this act, from the sale of property as hereinafter provided,
or may issue general obligation bonds or bonds payable from revenue derived
from service charges made for the use of the facility of the county as
hereinafter provided. Before any bonds shall be issued by any county under
the provisions of this act, the board of county commissioners shall publish
a notice once each week for two (2) consecutive weeks in the official
county newspaper. Such notice shall state the purpose, whether for
acquisition or improvement of a site, or both, describing any such
improvement, or the acquisition of equipment, for which such bonds are to
be issued and the amount of the bonds to be issued therefor and whether
they are to be general obligation bonds or revenue or part general
obligation bonds and part revenue bonds. If within thirty (30) days after
the last publication of said notice there shall be filed in the office of
the county clerk, not later than five (5) o'clock p.m. on the last day, a
protest signed by electors of the county equal in number to not less than
ten percent (10%) of the electors who voted in such county for the
secretary of state at the last preceding general election, an election
shall be called and held within ninety (90) days after the last publication
of the notice or at the next general election if held within that time. The
signatures to such protest need not all be appended to one (1) paper but
one (1) of the signers of each such paper shall make oath before an officer
competent to administer oaths that each signature to the paper is the
genuine signature of the person whose name it purports to be. Such election
shall be called and held in the manner provided by the general bond law for
bond elections. If no protest or no sufficient protest is filed or if an
election is held and the proposition carries by a majority of those voting
thereon at the election, the board of county commissioners may provide for
the issuance of such bonds for the purposes and in the amount or amounts
(if part are general obligation and part revenue bonds) provided in the
published notice in the manner provided by law. Such bonds are hereby
exempt from and shall not be included in computing the total bonded
indebtedness of any county as prescribed by article 3 of chapter 10 of the
Kansas Statutes Annotated.
