Article 26.--MISCELLANEOUS PROVISIONS

      19-2661.   Same; fees and charges; fund, use; expenses from generalfund, when.If no revenue bonds are outstanding the board of county commissionersmay establish a schedule of fees and charges for the use of such facilityand all moneys received therefrom shall be placed in a fund to be known asthe refuse disposal fund and shall be used only for the purpose of payingfor the operation of such disposal facility, for the making of repairs orreplacements or construction of additional facilities at such site or thereplacement of equipment. At any time that there may be a surplus in suchfund and there are outstanding general obligation bonds, such surplus shallbe placed in a sinking fund which shall only be used for the purpose ofredeeming bonds which were issued for the acquisition or improvement ofsuch facility or equipment used in connection therewith.

      If revenue bonds are issued the board of county commissioners shallestablish a schedule of fees and charges for the use of the facility toproduce revenue sufficient to pay the bonds and interest, and any revenueover and above the amount necessary to pay the revenue bonds and interesteach year may be used for the operation of the facility and for maintenanceand improvements of and related to such facility. The revenue shall beplaced in a refuse disposal fund. If the revenue is not sufficient toprovide for operation, maintenance and improvement after bond and interestpayments are made, such operation, maintenance and improvement expenseshall be paid from the general fund of such county.
