19-27a05. Notice; hearing; district extending into city limits.(a) Prior to the creation of a sewer district, the board of county commissionersshall publish a notice stating: (1) Its intent to create a sewer district,(2) a description of the area of the proposeddistrict or the property within the boundaries in sufficient detail to advisethe landowners within the proposed district of the proposal, and (3) thedate and location of a public hearing to be held to consider the creationof the sewer district and to hear objections thereto. The notice shallbe published in a newspaper of general circulation in the county at least10 days prior to the date of the hearing. Notice of the hearing also shallbe mailed by prepaid first class mail, at least 14 days prior to the dateof the hearing, to all landowners within the proposed district. The failureof any landowner to receive notice shall not invalidate creation of thedistrict or any apportionment of costs therefor. Notice need not be givenwhen a petition requesting the creation of a district is signed by 100%of the landowners subject to assessment in a proposed district.
(b) The board of county commissioners shall not create any sewer districtwithin or extend any sewer district into the limits of any incorporatedcity without the consent of the governing body of the city.
