Article 27.--PUBLIC IMPROVEMENTS; IMPROVEMENT AND SERVICE DISTRICTS

      19-2752b.   Enlargement of main sewer district; petition; resolution;tax levies.Subject to the provisions of K.S.A. 19-270, the governing body of a mainsewer district created and establishedunder the provisions of K.S.A. 19-2731 to 19-2752, inclusive, and amendmentsthereto, by resolution, may enlargethe boundaries of the district upon thepresentation of a petition, approved by the sewer district engineer, andsigned by the owners, or others having expressly reserved the right to doso, of 51% of the area sought to be added to suchdistrict. Such resolution shall provide for the levying of taxes andassessments upon the land in such added area, the same as are being leviedupon the lands in the main sewer district, to pay the principal andinterest upon outstanding bonds issued for the purpose of paying the costof improvements of such main sewer district, and shall also provide for anadditional levy upon the lands in such added area to pay a proportionateshare of all amounts previously paid by the main sewer district upon anybonds issued for such purpose. No such landmay be added to the main sewer district except where the sewage therefrommay flow by gravity into the mains in the main sewer district. Suchadditional levy shall be made over a period of from one to fiveyears, as determined by the governing body, and the proceeds therefromshall be credited to the bond and interest fund of the main sewer district.
