19-2786h. Same; tax levies for additional police
protection; contracts with sheriff.
The governing body of any improvement district may annually levy a tax,
which shall be in addition to all
other levies or taxes authorized by law, in an amount not to exceed
three mills, to be used for additional police protection in the
district as hereinafter set out. No such tax levy shall be authorized
without first having been submitted to and been approved by a majority
of the electors of the district voting at an election called and held
thereon. Such election shall be called and held in the manner prescribed
for the calling and holding of bond elections under the provisions of
K.S.A. 10-120. Any such improvement district making such levy shall contract
with the sheriff of the county wherein such improvement
district is located for the furnishing of specific police protection
within the district by the use of sheriff's deputies and equipment. The
annual amount to be paid by such improvement district to the sheriff of
such county from the proceeds of the levy shall not exceed the amount to
be raised by the tax levy authorized herein. Such contract shall be in
such form as the parties may agree but shall be subject to the approval
of the attorney general of Kansas. Notwithstanding the provisions of any
other law to the contrary, the salary and general budget limitations of
any sheriff of any such county is hereby raised by the amount that the
sheriff is to receive under the terms of a contract with the improvement
district and such amount so received may be budgeted and expended by the
sheriff for salaries, equipment or any other purpose as may be otherwise
allowed by law.
