Article 27.--PUBLIC IMPROVEMENTS; IMPROVEMENT AND SERVICE DISTRICTS

      19-27,130.   Same; creation, designation and determination ofboundaries; petition by city; publication and filing resolution.The county commissioners shall upon the receipt of a petition by thegoverning body of any city in which all or a part of any land lying withinthe proposed drainage district is located provide by resolution for thecreation of a storm drainage district: Provided, That no districtshall include territory lying within more than one city except uponpetition by the governing bodies of all cities within which territory ofsuch drainage district is located and no territory lying within thecorporate limits of any city shall be included within the boundaries of anydrainage district except upon petition by the governing body of such city:Provided further, That within such city only that area lying withinthe natural drainage or watershed area of the proposed district shall beincluded in such district. The board of county commissioners shall be thefinal authority in determining the boundaries and the territory to beincluded within any drainage district. Such resolution shall designate thedistrict by appropriate name or number, define and fix the boundaries ofthe district, contain a map showing the location of the same, and shall bepublished once in the official county newspaper. A certified copy of suchresolution shall be filed in the office of the county clerk and theregister of deeds of such county.
