Article 27.--PUBLIC IMPROVEMENTS; IMPROVEMENT AND SERVICE DISTRICTS

     
19-27,130.   Same; creation, designation and determination of
boundaries; petition by city; publication and filing resolution.

The county commissioners shall upon the receipt of a petition by the
governing body of any city in which all or a part of any land lying within
the proposed drainage district is located provide by resolution for the
creation of a storm drainage district: Provided, That no district
shall include territory lying within more than one city except upon
petition by the governing bodies of all cities within which territory of
such drainage district is located and no territory lying within the
corporate limits of any city shall be included within the boundaries of any
drainage district except upon petition by the governing body of such city:
Provided further, That within such city only that area lying within
the natural drainage or watershed area of the proposed district shall be
included in such district. The board of county commissioners shall be the
final authority in determining the boundaries and the territory to be
included within any drainage district. Such resolution shall designate the
district by appropriate name or number, define and fix the boundaries of
the district, contain a map showing the location of the same, and shall be
published once in the official county newspaper. A certified copy of such
resolution shall be filed in the office of the county clerk and the
register of deeds of such county.
