Article 27.--PUBLIC IMPROVEMENTS; IMPROVEMENT AND SERVICE DISTRICTS

      19-27,186.   Same; action by governing body; protest petitions.The governing body, by a majority vote of the entiremembership thereof, at any time within six months after the finaladjournment of the hearing on the advisability of making the improvements,may adopt a resolution authorizing the improvement in accordance with thefinding of the governing body upon the advisability of the improvement, asprovided in K.S.A. 19-27,184, which shall be effective uponpublication once in thenewspaper. The improvement shall not be commenced if, within 20 days afterpublication of the resolution ordering the improvement, written protestssigned by both 51% or more of the resident owners of record of propertywithin the benefit district and the owners of record or more than 1/2 ofthe total area of such district are filed with the county clerk. Names maybe withdrawn from any protests by the signers thereof at any time beforethe governing body convenes its meeting to determine the sufficiencythereof. No benefit district lying within the fringe area of a city asdefined in K.S.A. 19-270, and amendments thereto, shall be establisheduntil the county has complied with the provisions thereof. Any resolutionestablishing a benefit district under the terms of this act shall be filedwith the register of deeds in accordance with K.S.A. 12-153, and amendmentsthereto.
