19-2817.   Agreement with department of wildlife and parks.The board of county commissioners of any county to which this act appliesand the secretary of wildlife and parks are each authorized and empoweredto enter into an agreement to provide for thebuilding and construction of one or more reservoirs, lakes, dams orembankments for impounding water on lands in the park and recreationalgrounds of any such county and to provide for the use, control andmaintenance of such park and recreational grounds. Nothing in suchagreement shall be construed to prohibit the secretary of wildlife andparks or the Kansas department of wildlife and parks from the right toexercise the same functions, rights and authority as though the lands forsuch park and recreational grounds had been acquired for the department,and the agreement between any such county and the secretary shall expresslyprovide that, notwithstanding the title to such lands shall be vested insuch county, all rights therein or thereon, waters and water rights, andfor keeping, improving and maintaining them for the use and benefit ofthe department shall be unimpaired and shall likewise be public park andrecreational grounds for the use and enjoyment of the public.
