19-2844. Agreements with department of wildlife and parks.The boards of county commissioners of any counties to which this actapplies and the secretary of wildlife and parks are authorized andempowered to enter into an agreement to provide for the building andconstruction of one or more reservoirs, lakes, dams or embankments forimpounding water on lands in the park and recreational grounds of any suchcounties and to provide for the use, control and maintenance of such parkand recreational grounds. Nothing in such agreement shall be construed toprohibit the secretary of wildlife and parks or the Kansas department ofwildlife and parks from the right to exercise the same functions, rightsand authority as though the lands for such park and recreational groundshad been acquired for the department, and the agreement between any suchcounties and the secretary shall expressly provide that, notwithstandingthe title to such lands shall be vested in such counties, all rightstherein or thereon, waters and water rights, and for keeping, improving andmaintaining them for the use and benefit of the department shall beunimpaired and shall likewise be public park and recreational grounds forthe use and enjoyment of the public.
