Chapter 19.--COUNTIES AND COUNTY OFFICERS


Article 28.--PARKS, MUSEUMS, LAKES AND RECREATIONAL GROUNDS

     
19-2861.   Same; petition; notice and hearing; establishment.
The park district shall be created in the following manner: When a
petition, setting forth the boundaries of the proposed district in metes
and bounds or other legal description sufficient definitely to identify the
area to be included in the district, and requesting the creation of the
area into the park district as by this act provided, and signed by not less
than five thousand (5,000) qualified electors of the area described in the
petition as shown by the registration books in the office of the county
clerk, is presented to the board of county commissioners of Johnson county,
the board of county commissioners shall fix a time for a hearing upon such
petition and direct the county clerk to give notice thereof for three (3)
consecutive weeks in a newspaper of general circulation within the
district, the last publication to be at least five (5) days before the day
fixed for the hearing. The notice shall describe the boundaries of the area
as shown by the petition, shall state that the petition requests the
creation of the Shawnee Mission park district as authorized by this act,
shall state that a hearing will be held by the board of county
commissioners, shall state the day and the hour of the hearing, and that
all persons interested may appear before the board of county commissioners
at such hearing and be heard.

     
Before setting such hearing the board of county commissioners shall
determine whether the petition is in compliance with the provisions of this
act, whether the description of the area is sufficient, and whether the
required number of qualified electors signed the petition which findings
shall be incorporated in an appropriate order. If it finds the petition to
be in compliance with this act, the boundaries of the area sufficiently
described and that the required number of qualified electors have signed
the petition, the board of county commissioners shall proceed with such
notice and hearing and if after such hearing it determines that the
interests of the area will be advanced by the creation of the park district
it shall so find, and shall adopt a resolution creating such district
setting forth therein its findings on all points, together with a
description of the boundaries. Such park district thus created shall be
known by the name and style of "the Shawnee Mission park district." One
copy of the resolution shall be filed with the county clerk and one copy
shall be filed with the county treasurer.
