19-2861.   Same; petition; notice and hearing; establishment.The park district shall be created in the following manner: When apetition, setting forth the boundaries of the proposed district in metesand bounds or other legal description sufficient definitely to identify thearea to be included in the district, and requesting the creation of thearea into the park district as by this act provided, and signed by not lessthan five thousand (5,000) qualified electors of the area described in thepetition as shown by the registration books in the office of the countyclerk, is presented to the board of county commissioners of Johnson county,the board of county commissioners shall fix a time for a hearing upon suchpetition and direct the county clerk to give notice thereof for three (3)consecutive weeks in a newspaper of general circulation within thedistrict, the last publication to be at least five (5) days before the dayfixed for the hearing. The notice shall describe the boundaries of the areaas shown by the petition, shall state that the petition requests thecreation of the Shawnee Mission park district as authorized by this act,shall state that a hearing will be held by the board of countycommissioners, shall state the day and the hour of the hearing, and thatall persons interested may appear before the board of county commissionersat such hearing and be heard.

      Before setting such hearing the board of county commissioners shalldetermine whether the petition is in compliance with the provisions of thisact, whether the description of the area is sufficient, and whether therequired number of qualified electors signed the petition which findingsshall be incorporated in an appropriate order. If it finds the petition tobe in compliance with this act, the boundaries of the area sufficientlydescribed and that the required number of qualified electors have signedthe petition, the board of county commissioners shall proceed with suchnotice and hearing and if after such hearing it determines that theinterests of the area will be advanced by the creation of the park districtit shall so find, and shall adopt a resolution creating such districtsetting forth therein its findings on all points, together with adescription of the boundaries. Such park district thus created shall beknown by the name and style of "the Shawnee Mission park district." Onecopy of the resolution shall be filed with the county clerk and one copyshall be filed with the county treasurer.
