19-2873. Same; rules andregulations; conduct, fees, leases.The board may by resolution adopt rules and regulations for theoperation of the park and recreation district and rules and regulationsapplying to any particular park or playground and prescribe penaltiesfor violation of any rules and regulations relating to the conduct ofpersons in the parks and playgrounds or park or playgrounds, suchpenalties not to exceed imprisonment in the county jail for not toexceed three months or by fine of not to exceed $100, or both such fine andimprisonment. Any rules and regulations forthe conduct of persons, applying to all parks or any park and providingpenalties, shall be published once in the official county paper andcopies of the rules and regulations shall be posted and kept posted inall parks to which they are applicable, and the violation of any penalrule or regulation when so published and posted shall constitute amisdemeanor.
No charge shall be made for entrance into any park and no admissioncharge shall be made for use of any of the facilities of any park. Theboard may lease sites for food, soft drinks, boat rentals, amusementsand other concessions as in its judgment may be deemed appropriate andlawful for the comfort, convenience and enjoyment of the public, and maylimit purchase and use charges to be made by concessionaires inoperating the same. The board may establish and operate food, softdrinks, boat rentals, amusements and other lawful and appropriateconveniences as may in its judgment be necessary or appeal to the publiccomfort and enjoyment, all in accordance with K.S.A. 19-2873a andamendments thereto. A reasonable fee may be charged for recreationalactivities and the board may regulate and control all fishing and boatingwithin the boundaries of park property, including daily and possessionlimits of fish caught and time limits when fishing may be restricted,subject to law and rules and regulations of thesecretary of wildlife and parks with respect to such fishing and boating; andmay require a park permit for fishing and boating for which a reasonablefee may be charged all persons so engaged.
A separate schedule of fees may be established fornonresidents. The board may enter into long term leases forsuch authorized concessions, not to exceed 50 years, under theterms of which the concessionaires (lessees), shall at their ownexpense, construct and install the facilities and improvements to beoccupied and used under such lease, upon such terms, conditions andcontrol as the park and recreation district may require and subject inall such long term leases to unconditional reversion of title to suchfacilities and improvements so constructed by the concessionaire to thedistrict upon the expiration of the term of such lease or uponabandonment or forfeiture thereof by the concessionaire prior to itsexpiration.
