Article 28.--PARKS, MUSEUMS, LAKES AND RECREATIONAL GROUNDS

      19-28,106.   Same; petition for creation; notice andhearing; resolution of county commissioners.(a) Whenever a petition signed by one thousand (1,000) qualifiedelectors of an urban area county shall be presented to the board of countycommissioners of such county, requesting the creation of a county sportsauthority in such county, said board shall hold a public hearing on thepetition. The board shall give notice of the hearing by publication in anewspaper of general circulation in the county once each week for two (2)consecutive weeks. Such notice shall state the time, location and purposeof such hearing, but the date set for the hearing shall not be more thanthirty (30) days from the date said petition is presented to the board. Ifnecessary, the hearing may be continued by resolution of the board.

      (b)   Upon the termination of the hearing the board is hereby authorizedby duly adopted resolution to create a county sports authority, if theyfind such action to be in the best interests of the people resident in thecounty. A certified copy of said resolution shall be filed in the office ofthe secretary of state, and upon the filing thereof, said authority shallbe a body corporate and politic and a political subdivision of the state ofKansas.
