19-28,108. Same; powers.In addition to other powers enumerated by this act, the authority shallhave the power:
(a) To acquire by gift, bequest, purchase or lease from public orprivate sources and to plan, construct, operate and maintain, or tolease to others for construction, operation and maintenance, a sportsstadium, field house, indoor and outdoor recreational facilities,centers and playing fields, necessary access roads to connect withexisting thoroughfares or interstate highways, parking facilities, andother suitable concessions, and to do all things incidental or necessaryto establish a commercial or private complex, located upon, above orbelow the ground, for the types of sports and recreation, professionalor amateur, which are deemed suitable therefor by the authority;
(b) To adopt a common seal;
(c) To enter into contracts, including but without limitation, thepower to enter into contracts with counties and other politicalsubdivisions: Provided, That any contract entered into by theauthority with any person, providing for a term of use or occupancy bysuch person of any building or facility of the sports complex exceedingtwenty-five (25) days in any calendar year, shall not be effectiveunless such contract is first approved by the board;
(d) To sue and be sued;
(e) To receive for its lawful activities any contributions or moneysappropriated by the state, any city, county or other politicalsubdivision or agency or by the federal government or any agency orofficer thereof or from any other source;
(f) To disburse funds for its lawful activities;
(g) To borrow money for the acquisition, planning, construction,equipping, operation, maintenance, repair, extension and improvement ofany facility, or any part or parts thereof, which it has the power toown or to operate, and to issue negotiable notes, bonds, or otherinstrument in writing as evidence of sums borrowed, as provided inK.S.A. 19-28,109;
(h) To condemn any and all rights and property, of any kind orcharacter, necessary for the purposes of the authority, in the mannerprovided in the acts contained in article 5 of chapter 26 of the KansasStatutes Annotated, and any acts amendatory thereof: Provided, Thatno property now or hereafter vested in or held by the state or by anycounty, city, township, school district or other political subdivisionshall be taken by the authority without the consent of such politicalsubdivision; and
(i) To perform all other necessary and incidental functions, and toexercise such additional powers as shall be conferred by the legislatureor by act of congress.
