Chapter 19.--COUNTIES AND COUNTY OFFICERS
Article 31.--CEMETERIES

      19-3104.   Same; care and maintenance by county; purchase of adjoininglands; eminent domain.Lands acquired for cemetery purposes under the provisions of this act bythe county shall be under the control of the board of county commissionersand such board shall have full power to make and enforce all necessaryrules and regulations pertaining to the custody, control and care of thecemetery and to determine and collect the price to be paid for lotstherein: Provided, That all funds arising from the sale of lots in anycemetery so acquired shall be applied solely to the care and maintenance ofsuch cemetery. The board shall have power to purchase land adjoining anysuch cemetery whenever in their judgment the same is needed for cemeterypurposes. If the board of county commissioners cannot agree with the owneras to the price to be paid for any such land, condemnation procedure may beinstituted by said board and prosecuted in the name of the county under theprovisions of the law in similar cases.
