19-3521b.   Grant of easement to water district no. 1of Johnson county; conditions; purposes; costs.(a) The secretary of state is hereby authorized and directedto grant an easement to water district no. 1 of Johnson county, Kansas, on atract of land owned by the state of Kansas along the south and north banks ofthe Kansas river described as follows: Commencing atthe east half of the southeast quarter of the southwest quarter of Section 31,Township 11 South, Range 24 East, the east half of the northeast quarter of thesouthwest quarter of Section 31, Township 11 South, Range 24 East, and thesoutheast quarter of Section 31, Township 11 South, Range 24 East. Less thatpart of the above described tract lying northerly of the northerly high bank ofthe Kansas River and less that part of such tract lying southerly of thesoutherly high bank of the Kansas River.

      (b)   Such easement shall be conditioned on water district no. 1 of Johnsoncounty assuming full responsibility for the use of such easement and holdingthe state of Kansas harmless therefor. Such easement shall terminate if theland is no longer used for the purpose for which the easement was granted.

      (c)   Water district no. 1 of Johnson county Kansas, is hereby authorized toacquire the easement described in subsection (a) and to use such easement forthe purpose of locating, constructing, maintaining and operating diversionworks for the appropriation of water and to assume full responsibility for suchuse and hold the state of Kansas harmless therefor.

      (d)   Water district no. 1 of Johnson county Kansas, shall assume fullresponsibility for any costs arising under this act.
