19-3538.   Creation of taxing district by board, when; territoryexcluded.Either with or without having had a preliminary survey prepared asprovided in K.S.A. 19-3537, and amendments thereto, and for the purpose ofproviding for the expenses of such water production and distributionfacilities, and upon presentation of a petition signed by the owners, orothers having expressly reserved the right to do so, of 51% or moreof the acreage of land in the district sought tobe created and subject to the provisions of K.S.A. 19-270, the board, byorder, may provide one or more taxingdistricts, but the board shall not have the power to create any suchdistrict within or to extend any district into the limits of anyincorporated city without the consent of its governing board.
