19-3603. Same; petition; contents; resolution; adoption andpublication, when.The board of county commissioners shall consider the advisability oforganizing any fire district or districts within the county upon thefiling of a petition with the county clerk, signed by the residents ofthe county owning more than sixty percent (60%) of the area of the landssituated within the boundaries of the proposed district. Each suchpetition shall describe the boundaries of any proposed district asprovided in K.S.A. 19-3602 and shall be accompanied byan outline map showing the proposed district and the tracts thereof heldby the signers of said petition. Each signer shall, after his name,enter the place of his residence with respect to some city or townshipwithin the county, the legal description of his land within the proposeddistrict and his supposed estate therein and if a corporation, the nameand home office of the corporation and the title of the officers signingthe petition. The board of county commissioners shall determine thesufficiency of any such petition by reference to the records of thecounty pertaining to any interest in real property. If any such petitionshall be found sufficient, said board may adopt and publish a resolutionorganizing and naming said district and declaring the boundaries thereofas provided in K.S.A. 19-3602: Provided, Thatnothing herein shall deny the authority of the board to organize a firedistrict under K.S.A. 19-3602.
