Chapter 19.--COUNTIES AND COUNTY OFFICERS
Article 36.--FIRE PROTECTION

      19-3612d.   Same; tax levies in certain counties; useof proceeds; limitation; election.The governing body of a fire district created under the provisions ofK.S.A. 19-3601 et seq., located in any county having apopulation of less than one hundred thousand (100,000) and an assessedtangible valuation of more than two hundred twenty-five million dollars($225,000,000) or located in any county having a population of more thanthree hundred thousand (300,000) is hereby authorized to makeexpenditures from the proceeds of a levy made pursuant to K.S.A. 19-3610in the current budget year for the purposes of compensation of the firedistrict employees and other general operating expenses. Allexpenditures heretofor made for such purposes from the proceeds of taxlevies under the provisions of such section are hereby authorized andratified.

      The governing body of such fire district shall have the power to levya tax of not to exceed nine (9) mills upon all taxable tangible propertyin the district for the purpose of paying compensation to fire districtemployees, the expenses of operating and maintaining a fire departmentand other legal expenses of the fire district. Before any such levy ismade, notice of the intended levy shall be made once each week for two(2) consecutive weeks in a newspaper of general circulation in the firedistrict. If within thirty (30) days after the last publication of thenotice, a petition signed by not less than five percent (5%) of thequalified electors in the fire district is filed in the office of thecounty election officer requesting an election thereon no levy shall bemade unless the question of the levy shall be submitted to and approvedby a majority of the voters of the fire district voting at an electioncalled by the governing body. Such election shall be called and held inthe manner provided under the provisions of K.S.A. 10-120.

      The governing body of such fire district may, whenever it isauthorized by a majority of the electors of the fire district voting atan election thereon, levy a tax of more than nine (9) mills but not morethan eleven (11) mills in any year upon the taxable tangible propertywithin such district for the purpose of paying compensation to firedistrict employees, the expenses of operating and maintaining a firedepartment and other legal expenses of the fire district. Such electionshall be called and held in the manner provided under the provisions ofK.S.A. 10-120.
