Article 36.--FIRE PROTECTION

      19-3621.   Same; contracts with other municipalities to provide fireprotection.The governing body of the fire district may enter into contracts withcities and other fire districts, townships, or duly organized andincorporated volunteer fire departments whether within or without thecounty or state, for cooperation between fire departments of therespective cities, districts and townships, and may include in suchcontracts provisions by which the fire department of such cities,townships or other districts or volunteer fire departments will furnishfire protection to the fire district in question inconsideration of cash payments or reciprocal services. The governingbody of the fire district may also include in such contracts provisionsto provide, furnish and pay for a bond in such amount as shall be agreedupon to indemnify any such city, fire district, or township against anyloss which it may sustain as result of damage to property or injury topersons arising out of the furnishing of fire protection services tosuch districts.

      The supervision and control of the firedistrict fire department shall always be with the governing body of thefire district. The fire chief or personin charge of the fire department shall have the right in every case,where a contract exists for reciprocal service, to determine whether ornot the district can spare all or any portion of its fire equipment andfirefighters at that particular time.
