19-430. County appraiser; appointment, term and qualifications;vacancies.(a) On July 1, 1993, and on July 1 of each fourth yearthereafter, the board of county commissioners of eachcounty shall by resolution appoint a county appraiser for such county whoshall serve for a term of four years and until a successor isappointed. County appraisers appointed in counties having a population ofmore than 25,000 shall devote full time to the duties ofsuch office but county appraisers appointed in counties having a populationof 25,000 or less may be appointed either as a full-timeor a part-time county appraiser as prescribed in the resolution providingfor such appointment. No person shall be appointed or reappointed to orserve as county appraiser in any county under the provisions of this actunless such person shall have at least three years of massappraisal experienceand be qualified by the director of property valuation as an eligible Kansasappraiser under the provisions of this act. Whenever a vacancy shall occur inthe office of county appraiser the board of countycommissioners shall appoint an eligible Kansas appraiser to fill suchvacancy for the unexpired term and until a successor is appointed. Theperson holding the office of county or district appraiser orperforming the dutiesthereof on the effective date of this act shall continue to hold suchoffice and perform such duties until a county appraiser is appointed underthe provisions of this act. No person shall be appointed to the office ofcounty or district appraiser or to fill a vacancy therein unless suchperson is currently: (1) A certifiedgeneral realproperty appraiser pursuant to article 41 of chapter 58 of the Kansas StatutesAnnotated and amendments thereto; (2) a registered mass appraiser pursuant torules and regulations adopted bythe secretary of revenue; or (3) holding a valid residential evaluationspecialist or certified assessment evaluation designation from theInternational Association of Assessing Officers.Notwithstanding the foregoingprovision, any person who holds the office of county or district appraiseron the effective date of this act and who is not eligible for reappointmentpursuant to this sectionshall be eligible for reappointment tosuch officeor appointment as a county or district appraiser in another county for a termexpiring on July 1, 1999, and if any such person qualifies for an originalappointment or reappointment prior to July 1, 1999, such person may bereappointed for a full term, and any other person who has at least three yearsof mass appraisal experience and is qualified by the director of propertyvaluation as an eligible Kansas appraiser shall be eligible for appointment tosuch office for a term expiring on July 1, 1999, and if any such personqualifies for an original appointment prior to July 1, 1999, such person may bereappointed for a full term.
(b) The secretary of revenue shall adopt rules and regulations prior toOctober 1, 1997, necessary to establish qualifications for the designation of aregistered mass appraiser.
