Chapter 2.--AGRICULTURE
Article 10.--COMMERCIAL FEEDING STUFFS

      2-1014.   Commercial feed license; fee; renewal;grounds to deny applicationor suspend license.(a) No manufacturer, importer, jobber, firm, association,corporation or person shall sell, offer or expose for sale or distribute inthis state any commercial feeding stuffs unless such person holds a validlicense for each manufacturing or distribution facility in this state. Nolicense shall be required of persons distributing only packages or containersof a licensed manufacturer, importer, jobber, firm,association, corporation or personas packaged and labeled by themanufacturer, importer, jobber, firm,association, corporation or personand whose name and address appear on the label asrequired in K.S.A. 2-1002, and amendments thereto. Any out-of-statemanufacturer, importer, jobber, firm, association, corporation or person whohas no distribution facility within this state shall obtain a license for suchentity's principal out-of-state office if suchout-of-state manufacturer, importer, jobber, firm, association, corporation,person or other entitysells, offers or exposesfor sale or distributes any commercial feeding stuffs in this state.Application shall be made on forms prescribed and furnished by the secretary ofagriculture. The application shall be accompanied by anannuallicense fee of $10. Licenses shall be renewed annually on or before July 1.

      (b)   The secretary, pursuant to rules and regulations, maydeny,suspend, revoke or refuse to renewthecommercial feed license ifthe applicant or the licenseeofany manufacturing or distributionfacility is not in compliance with the provisions of article 10 of chapter 2 ofthe Kansas Statutes Annotated, and amendments theretoand any rules andregulations promulgated thereunder. The secretary maydeny, suspend, revoke or refuse to renewany commercial feed license subsequently found not to be in compliancewith any provision of article 10 of chapter 2 of the Kansas Statutes Annotated,and amendments theretoand any rules and regulations promulgated thereunder. No commercial feedlicense shall bedenied,suspended, revoked or refused renewalunless the applicant or licensee has been given an opportunityfor a hearing in accordance with the provisions of the Kansasadministrative procedure act.

      (c)   The secretary, pursuant to rules and regulations, may request copies oflabels and labeling in order to determine compliance with the requirements ofarticle 10 of chapter 2 of the Kansas Statutes Annotated, and amendmentsthereto.
