2-1218.   Same; unlawful acts.It shall be unlawful, and a violation of this act, for any person; (a)to operate any anhydrous ammonia facility, any transportation equipment, orto sell or offer to sell any anhydrous ammonia, unless (1) the productcontainer, piping, valves, hose, appurtenances and equipment areconstructed and installed in accordance with the regulations adopted underthe provisions of K.S.A. 2-1212, as supplemented and amended; and

      (2)   the product container, piping, valves, hose, appurtenances and otherequipment are adequately maintained; and

      (3)   the stationary product container is located as required in theregulations adopted pursuant to K.S.A. 2-1212, as supplemented and amended:Provided, This subsection shall not apply (A) to a stationary productcontainer located prior to the adoption of the regulations, or (B) to astationary product container properly located at the time of itsinstallation.

      (b)   To use any product container, piping, valve, hose, appurtenances orother equipment for handling anhydrous ammonia which is defective or whichis otherwise unsafe.

      (c)   To fail to provide, or fail to have available, for use such safetymaterial and such effective safety equipment, as required by regulation.

      (d)   To impede, obstruct or hinder, or to otherwise prevent or to attemptto prevent, any authorized state administrative personnel or employee inthe performance of his or her duties in connection with the administrationof this act.
