2-1222. Issuance of stop sale or stop use orders.(a) The secretary or a duly authorized representative of thesecretary,acting as the enforcing officer, may issue and enforce a written or printedstop sale or stop use order to the owner or custodian of any facility orequipment used for the storage, handling or transportation of anhydrous ammoniawhich the secretary or duly authorized representative determines is not incompliance with the provisions of K.S.A. 2-1212 through 2-1220, and amendmentsthereto, or any rules and regulations adopted thereunder. The stop sale orstopuse order shall prohibit the sale of anhydrous ammonia or prohibit further useof such facility or equipment for the handling, storage or transportation ofanhydrous ammonia, except on approval of the enforcing officer, until theenforcing officer has evidence that the law and rules and regulations have beencomplied with and issues a release from the stop sale or stop use order. Anystop sale or stop use order issued pursuant to this subsection is subject toreview in accordance with the act for judicial review and civil enforcement ofagency actions. The provisions of this subsection shall not be construed aslimiting the right of the enforcement officer to proceed as authorized by otherprovisions of the statutes contained in article 12 of chapter 2 of the KansasStatutes Annotated, and amendments thereto.
(b) This section shall be part of and supplemental to the provisions ofK.S.A. 2-1212 through 2-1220, and amendments thereto.
